How to report content stored on OnlyTrackr that you believe infringes your copyright, and how a customer can respond to a report about their content.

1. What this policy covers

OnlyTrackr respects intellectual property rights and responds to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (“DMCA”) and similar laws, including notices under the EU Digital Services Act.

OnlyTrackr is a management tool. It stores only a limited amount of content that our customers upload to it, such as images and videos queued for publishing, promotional images, captions and message templates. This policy covers that content only.

Content published on OnlyFans or another platform is hosted by that platform, not by us, even when it was scheduled or sent through our tool. To report it, contact that platform directly. We also do not provide takedown services for content that has been leaked or reposted on other websites.

2. Filing a notice

If you believe content stored on our Service infringes a copyright you own or are authorised to act for, send us a written notice that includes:

  1. your physical or electronic signature;
  2. identification of the copyrighted work you claim is infringed, or a representative list if several works are covered by one notice;
  3. identification of the material you claim is infringing, with enough information for us to find it, such as the account, the scheduled item or the file concerned;
  4. your name, postal address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law;
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner’s behalf.

A notice that is missing any of these may not be acted on.

3. Where to send it

Send notices to our designated copyright agent at support@onlytrackr.com, with “DMCA notice” in the subject line, or by post to: Copyright Agent, OnlyTrackr Ltd., Example Street 1, 110 00 Prague, Czech Republic.

This address is for copyright notices only. Other messages sent to it may not receive a reply.

4. What happens next

When we receive a complete notice, we remove or disable access to the material concerned promptly, and we tell the customer who stored it, including a copy of the notice. The copy may include your name and contact details, so the customer can reach you or respond.

We do not decide who is right in a copyright dispute. Removing material in response to a notice is not an admission that it infringes, and we are not liable to anyone for removing material in good faith.

5. Counter-notices

If material you stored was removed and you believe that was a mistake, or that the material was misidentified, you can send a counter-notice to the same address. It must include:

  1. your physical or electronic signature;
  2. identification of the material that was removed and where it appeared before it was removed;
  3. a statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of a mistake or misidentification;
  4. your name, postal address and telephone number;
  5. a statement that you consent to the jurisdiction of the federal district court for the judicial district of your address, or, if your address is outside the United States, of any judicial district in which we may be found, and that you will accept service of process from the person who filed the original notice or their agent.

When we receive a complete counter-notice, we send a copy to the person who filed the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we may restore the material 10 to 14 business days after we received the counter-notice.

6. Repeat infringers

We close the accounts of customers who are the subject of repeated valid notices, in appropriate circumstances and at our discretion. We may also close an account after a single notice where the infringement is clear or serious.

7. False notices

Under the DMCA, anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for the damages that result, including costs and legal fees. If you are not sure whether material infringes your copyright, get legal advice before sending a notice.
